5. Prohibited Activities (General)
Customer and Users shall not use the IP Services in any manner that is unlawful, harmful, or that interferes with Quantum Wi-Fi's network or systems or the network of any other provider; interferes with other customers' use or enjoyment; infringes intellectual property or other rights; constitutes threatening/offensive conduct; constitutes spam/email/usenet abuse; creates a security risk; or violates privacy. Failure to adhere to rules, guidelines, or agreements applicable to services accessed via links from Quantum Wi-Fi-branded websites or Quantum Wi-Fi-branded content may constitute a violation of this AUP.
6. Unlawful Activities
IP Services shall not be used in connection with any criminal, civil, or administrative violation of any applicable local, state, provincial, federal, national, or international law, treaty, court order, ordinance, regulation, or administrative rule.
7. Intellectual Property and Rights Violations
IP Services shall not be used to publish, upload, download, post, transmit, distribute, store, or otherwise make available Content or engage in any activity that infringes, misappropriates, or otherwise violates intellectual property rights or privacy/publicity rights of Quantum Wi-Fi or any third party.
8. Threatening, Obscene, or Harmful Content
IP Services shall not be used to host, post, transmit, or retransmit Content that harasses or threatens the health or safety of others. For IP Services utilizing Quantum Wi-Fi web hosting, Quantum Wi-Fi may decline to provide such services if Content is determined by Quantum Wi-Fi to be unlawful or otherwise harmful.
9. Protection of Minors; CSAM
Quantum Wi-Fi complies with applicable laws pertaining to the protection of minors, including reporting child exploitation when appropriate. IP Services shall not be used to produce, transmit, distribute, or store child sexual abuse material. Suspected violations may be reported to NCMEC, and Quantum Wi-Fi may take steps including termination of service.
10. Spam / Email / Usenet Abuse
Violation of the CAN-SPAM Act of 2003 or any other applicable law regulating email services constitutes a violation of this AUP. Spam/email/usenet abuse is prohibited, including the categories listed in the current policy (e.g., unsolicited bulk messaging, header spoofing, mail relaying without permission, mail-bombing, harvesting addresses, etc.).
11. Security Violations
Customers are responsible for maintaining the security of systems and devices that connect to the IP Services, including necessary patches and operating system updates.
IP Services may not be used to interfere with, gain unauthorized access to, or otherwise violate the security of Quantum Wi-Fi's (or another party's) servers, networks, devices, software, or data, including the categories listed in the current policy (e.g., scanning/probing, hacking, phishing/impersonation, malware distribution, evading use limits, etc.).
12. Network Integrity; Excessive Use; Resale
Quantum Wi-Fi may implement reasonable network management practices to protect the network, comply with law, prevent abuse, and ensure fair use, including filtering, blocking, rate limiting, traffic shaping, and protocol/port restrictions.
Customer shall not (and shall not permit Users to):
- use the IP Services in a manner that materially degrades, disrupts, or harms network integrity or other customers' service;
- circumvent or evade usage limits, security controls, or access restrictions;
- resell, redistribute, or provide the IP Services to third parties outside the authorized service location or scope without Quantum Wi-Fi's prior written consent.
13. Customer Responsibilities
Customers remain solely and fully responsible for all Content and activity conducted using the IP Services. Quantum Wi-Fi has no responsibility for Customer/User Content or third-party content accessible via links, and such links do not constitute endorsements. Customers are responsible for taking prompt corrective actions to remedy violations and prevent recurrence.
14. Monitoring; Preservation; Cooperation
Quantum Wi-Fi has no obligation to monitor Customer/User activity or investigate suspected violations. However, Quantum Wi-Fi may (but is not required to) monitor, investigate, preserve, or disclose information relating to use of the IP Services to (i) comply with law, legal process, or governmental requests; (ii) enforce this AUP and/or the Service Agreement; (iii) protect Quantum Wi-Fi, its customers, Users, systems, and rights; and/or (iv) address fraud, security threats, or network abuse.
15. Enforcement; Suspension; Termination
Failure to comply may result in actions ranging from a warning to suspension or termination. When feasible, Quantum Wi-Fi may provide notice and an opportunity to cure. Quantum Wi-Fi may act immediately and without notice to suspend or terminate affected IP Services in response to a court order or government notice, or where Quantum Wi-Fi reasonably determines that the Customer's use may expose Quantum Wi-Fi to liability; harm or interfere with network integrity; interfere with other customers' use; violate law; or otherwise present an imminent risk of harm.
16. Incident Reporting (Non-Copyright)
Complaints (other than copyright claims) regarding violation of this AUP should be directed to abuse@quantumwi.fi and should include details reasonably sufficient to assist investigation (e.g., expanded headers, IP address(es), relevant transmissions, and log files).
17. Copyright; DMCA; Repeat Infringer Policy
Quantum Wi-Fi respects the intellectual property rights of others and maintains a policy for termination of IP Services, under appropriate circumstances, for repeat infringement (the "Repeat Infringer Policy"). Quantum Wi-Fi may terminate IP Services with or without notice where appropriate. Quantum Wi-Fi will process valid DMCA notifications, and continued receipt of infringement notifications associated with a Customer account may be used as a factor in determining repeat infringer status.
17.1 ISP Conduit Notices (17 U.S.C. § 512(a))
Quantum Wi-Fi provides transitory digital network communications services pursuant to 17 U.S.C. § 512(a). Quantum Wi-Fi provides an online form that copyright holders should use to submit notifications related to alleged infringement by users (including peer-to-peer file sharing). Due to notice volume, Quantum Wi-Fi may be unable to guarantee processing of conduit notices submitted outside the form.
Notices may also be sent:
- by email to copyright@quantumwi.fi with all Required Information included in <xml> coding; or
- by mail (with all Required Information) to:
Quantum Wi-Fi USA, LLC
Attn: Legal Department
1489 W. Palmetto Park Road, Suite 325
Boca Raton, FL 33486
Additional contact points: legal@quantumwi.fi; 1-888-880-5098.
Timing (processing preference): To facilitate investigation and correlation with relevant logs, Quantum Wi-Fi requests that conduit notices be submitted as promptly as possible and preferably within 20 days of the alleged activity. Notices received later may be difficult or impossible to correlate to network logs due to retention and operational constraints. (This is a processing/log-correlation preference and does not purport to redefine statutory requirements.)
Required Information (Conduit Notices): The notice should include the following:
- entity name, contact person, physical address, and email address of entity claiming infringement;
- timestamp (year, month, day, hour, minute, second);
- Quantum Wi-Fi IP address and port;
- number of files allegedly infringed;
- title/file name of the allegedly infringed work;
- good-faith belief / accuracy / authority statements under penalty of perjury.
17.2 Counter-Notice
To reduce exposure and align with standard DMCA practice, Quantum Wi-Fi should also accept counter-notices consistent with 17 U.S.C. § 512(g), including identification of the material, a statement under penalty of perjury of good-faith belief of mistake/misidentification, consent to jurisdiction, and signature, submitted to copyright@quantumwi.fi.
18. Indemnification
To the maximum extent permitted by law, Customer shall defend, indemnify, and hold harmless Quantum Wi-Fi, its affiliates, and their respective officers, directors, employees, agents, and contractors from and against any and all claims, demands, suits, damages, liabilities, losses, fines, penalties, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to (i) Customer's or any User's access to or use of the IP Services, (ii) any Content, (iii) any violation of this AUP or applicable law, or (iv) any allegation of infringement or rights violation by Customer or any User.
19. Disclaimers; Limitation of Liability
Nothing in this AUP expands Quantum Wi-Fi's obligations or liabilities beyond those set forth in the Service Agreement. Quantum Wi-Fi shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to enforcement actions taken under this AUP (including filtering, throttling, suspension, or termination), to the maximum extent permitted by law.
20. Severability; No Waiver
If any provision of this AUP is held invalid or unenforceable, the remaining provisions remain in full force and effect. Quantum Wi-Fi's failure to enforce any provision shall not constitute a waiver.
